The article examines the entry into application of the AI Act’s transparency obligations on 2 August 2026, a milestone marking the beginning of a new phase in the Regulation’s implementation. As highlighted in our comments, the focus is now shifting from understanding the legal framework to implementing it in practice.
One of the key messages is that these obligations extend well beyond organisations developing AI systems. Businesses using artificial intelligence in their products, services or communications should assess whether the AI Act’s transparency requirements apply to their activities and ensure that appropriate governance, policies and compliance measures are in place.
The article also considers the European Commission’s AI Office’s new supervisory role, the obligations applicable to providers of general-purpose AI models, and the practical significance of the Commission’s recently published guidance on the AI Act’s transparency requirements.
